The Short Answer

Toys are used for play, learning, promotion, resale, collecting, events and sensory support. Here is the short version, one line each.

1. Play. A child uses the toy the way it was designed. Every safety rule is written for this case. 2. Learning. A school, a parent or a programme uses the toy to teach a named skill. 3. Promotion. A brand gives the toy away to sell something else. The toy is the free part. 4. Resale. A shop buys the toy and sells it as stock. 5. Collecting. An adult buys the toy to display it, not to play with it. 6. Events. A host hands the toy out at a party, a fair or a wedding. 7. Sensory support. A carer uses the toy to calm or focus a child.

That list answers the question people type into a search box. It does not tell you what to put in an RFQ. The rest of this page is about that.

Why the Use Changes the Order, Not Just the Product

Take one item: a small plastic animal. Sell it in a toy shop and it needs a retail box, an age grade and a batch of test reports. Give the same animal away in a fast-food meal and it needs all of the above, plus a shorter lead time and a much lower unit cost. Sell it as a display figure for adult collectors and the test bill changes again.

Same mould, three orders, three different cost structures. The uses of toys are not a trivia question. They are the first line of your spec sheet, and they decide four things:

which safety rules apply;

how the product is packed;

what you can print on it;

how much the factory charges per unit.

Get the use wrong on the RFQ and you will get a quote for the wrong product. It happens more often than buyers admit.

Use Is Not the Same Thing as Function

Keep these two apart, because they lead to different paperwork. Function is what the toy does. Use is what the buyer does with it. A musical toy has a sound function. That same toy can be a shop product, a free giveaway or a party bag filler — one function, three uses, three orders.

Our page on the functions of toys covers the first question: what the toy does, and which certificate each feature adds. This page covers the second: where the toy ends up, and what that does to your order.

The Rule Buyers Get Wrong: A Label Does Not Decide the Use

This is the part worth the read. Plenty of buyers think they can talk their way out of toy rules by changing the label. You cannot. Both big markets say so in writing.

In the US, the Consumer Product Safety Commission decides what counts as a children’s product with four factors, set out in 16 CFR 1200.2(c). They are:

1. what the maker says the product is for, including the label, if that claim is reasonable; 2. whether the packaging, display, promotion or advertising points at children 12 and under; 3. whether buyers in general see it as a product for children 12 and under; 4. the CPSC’s Age Determination Guidelines.

Then comes the line that catches people out. The rule says a maker’s claim that a product is not for children does not stop it being regulated as a children’s product. That is the case whenever the main appeal is to children 12 and under. The rule names three signs: decorations that invite a child to play, a child-sized format, or marketing aimed at children. And it adds that “the manufacturer’s label, in and of itself, is not considered to be determinative.”

The EU says the same thing in plainer words. Its guidance on decorative and collector products states that the reasonably foreseeable use wins over the maker’s own declaration. It also says that if a maker labels a product as not a toy, that maker has to be able to back the claim up.

So a sticker saying “not a toy” buys you nothing on its own. What you actually have to change is the product: its size, its theme, its price point, its fragility, where it is sold and who it is marketed to.

The One Place the Two Markets Differ

Here is the useful gap. The EU gives you a marked path. The US does not.

Under the EU Toy Safety Directive, “toy” means a product made or intended for children under 14 to play with. Annex I then lists products that are not toys, and item 2 covers products for collectors, provided the product or its packaging carries a visible and legible mark saying it is for collectors aged 14 and over. The examples given are detailed scale models, kits for them, decorative dolls, historical replicas of toys and reproductions of real firearms.

The US has no age threshold you can print and rely on. It has four factors and a judgement call. CPSC’s own text describes what separates an adult collectible from a child’s one: themes unsuitable for children 12 and under, high cost, limited production, fragile features, and display features such as hooks or pedestals, plus not being sold next to children’s products. Its example is a pair of bears. The collector bear costs more, is highly detailed, has fragile accessories and comes with a display case. The child’s bear costs less and has simple parts a child can handle without breaking them.

Practical reading: a mark that works in the EU may do nothing in the US. If you ship the same display figure to both, plan for the stricter reading.

Two More Things Buyers Miss

Free is not a category. Handing a toy out for nothing does not move it outside the safety rules. CPSC publishes a guide aimed straight at this, called *Buying Promotional Products: A Guide to Federal Safety Laws*. It tells promotional buyers to understand federal safety laws, especially when products are designed to appeal to children 12 and under, and reminds them that children’s products need tracking marks.

The US now wants the certificate at the border. CPSC revised 16 CFR part 1110, and importers must file certificate data electronically with CBP at entry. The dates are 8 July 2026 for general imports and domestic manufacture, and 8 January 2027 for goods leaving a foreign trade zone. The rule did not change which products need a certificate. It changed when and how the data is handed over. If you import into the US, ask your broker which filing method you are on before your next shipment.

7 Uses of Toys, and What Each One Changes About Your Order

Below, each of the seven uses of toys gets the same four lines: what it is, what it does to the paperwork, what it does to the pack, and the mistake to avoid. Prices are a rough guide, not a promise.

1. Play at Home

The baseline case. A child plays with the toy at home, and every standard you have heard of was written for this.

Paperwork: full toy testing. In the US that means ASTM F963 and the CPSIA limits. In the EU it means EN 71 and a CE mark. Our page on toy testing labs for CE, ASTM and EN 71 covers who runs them.

Pack: retail-ready, with an age grade and warnings on the box.

Mistake to avoid: shipping without an age grade. Learning and School Use

A school or a parent buys the toy to teach something specific. The word “educational” is doing real work here, and it carries a claim you have to defend.

Paperwork: the same toy tests as above, plus whatever the school district or the platform asks for. Printed learning claims need to match what the toy does.

Pack: often bulk, not retail. Schools buy in cartons, and they want an instruction sheet, not a hanging box.

Mistake to avoid: printing a skill the toy cannot teach. Promotional Giveaways

A brand gives the toy away to sell something else — a meal, a bank account, a cereal box. This is the use where buyers most often assume the rules are lighter. They are not.

Paperwork: the full children’s product set if the item appeals to children 12 and under. CPSC has a guide written for exactly this buyer. Tracking marks are required.

Pack: bulk, loose or in a printed bag. Cost per unit is the whole game, so retail packaging is gone.

Mistake to avoid: assuming “free” lowers the bar. It does not. It raises the volume, which raises the size of the recall if you get it wrong.

Unit cost for this use is low by design, and MOQ is high to match. See promotional toy sourcing for how the volume side works, or promotional products wholesale if the toy is one line in a wider gift programme. If the toy is only part of the brief, promotional items covers the rest of the catalogue.

4. Retail Resale

A shop buys the toy to sell it. This is the use where packaging stops being a cost and starts being a sales tool.

Paperwork: full testing plus the retailer’s own checks. Big chains add their own audit on top of the law.

Pack: retail-ready, barcoded, shelf-ready. Often this means a window box or a hanging card, not a plain carton.

Mistake to avoid: quoting bulk packing and then discovering the retailer wants shelf-ready. Retrofitting packaging after production is the most expensive way to fix it.

Retail buyers also carry the widest test burden, because the chain adds its own audit on top of the law. Premium toys wholesale is where most of that range sits.

5. Collecting and Display

An adult buys the toy to put it on a shelf. This is the one use that can genuinely leave the toy rules behind — but only if the product backs the claim up.

Paperwork: depends entirely on whether the claim holds. If you have not shipped from China before, how to import toys from China walks through the steps around these numbers.

How to Write the Use Into Your RFQ

One sentence is enough, and it should sit at the top of the sheet. Write it like this:

> *Use: [promotional giveaway] for [children aged 3–6], given away [in-store], packed [bulk, 100 per inner carton], printed with [one-colour logo].*

Four things go in there on purpose. Who uses it sets the test path. Where it is handed out tells the factory how it will be treated. How it is packed decides whether you get a retail quote or a bulk one. What is printed tells the factory whether it needs a printing plate or a mould change.

Then add four asks. First, ask which standard the quote is tested to — a cheap quote often assumes a lighter test than you need. Second, ask for the certificate with the quote, not after it. Third, ask for a sample packed the way you will ship it. A retail sample will not tell you whether a bulk giveaway survives the trip. Fourth, confirm the payment terms before tooling starts: most factories work on a T/T deposit with the balance against the bill of lading, and the deposit is what releases your mould.

Two of those asks are about money, and two are about the uses of toys you wrote on line one. If you ship to the US, also confirm who files the certificate data at entry. That is now an import step, not a paperwork afterthought.

FAQ

What are toys used for besides play? Besides play, the main uses of toys are teaching, brand promotion, resale, adult collecting, party and event handouts, and sensory support. Each use changes the paperwork, the pack and the price.

Is a free giveaway toy exempt from toy safety rules? No. CPSC publishes a guide for promotional product buyers that says the opposite. If the item appeals to children 12 and under, the children’s product rules apply, including tracking marks.

Can I label a toy “not a toy” and skip the tests? No, not on its own. US rules say the label in itself is not determinative. EU guidance says the reasonably foreseeable use wins over what the maker declares. You have to change the product, not the wording.

What age mark makes a collectible in the EU? Annex I of the Toy Safety Directive covers products for collectors, provided the product or its packaging carries a visible, legible mark saying it is for collectors aged 14 and over.

Does the EU still use Directive 2009/48/EC? Yes, for now. Regulation (EU) 2025/2509 entered into force on 1 January 2026 and replaces the Directive from 1 August 2030. Until then, toys placed on the EU market still meet the Directive.

Which use has the lowest unit cost? Promotional giveaways, because the pack is stripped out and the volume is high. The saving comes from the packaging, not from the safety work.

Next Step

Pick the use before you pick the product.
