Car makers treat scale replicas as a licensed product category and they enforce it.

The legal picture is more nuanced than suppliers suggest, and it cuts both ways.

Where the brand wins. Customs authorities treat unauthorised replicas as counterfeits. US Customs Directive 2310-010A lists “certain replicas, models, toy cars” as goods that can be seized under 19 CFR 133.21. Seizures happen. Jiuzhou Customs reported one detention of 662 cartons holding 8,796 sets. The declared value was USD 29,600. The models covered Ferrari, Ford, Honda and Jaguar.

Where the model maker wins. In May 2025 the Hamburg Higher Court dismissed Volkswagen’s case against a model car maker (5 U 61/21). The court held that scale models form their own market. An accurate replica does not infringe the design. What it cannot do is suggest it is officially licensed.

Read together, those two facts give you the practical rule.

Making an accurate model is defensible in court.

Importing one without a licence is still a customs risk.

Claiming or implying official approval without one is the part that gets you sued.

Most buyers take the licence. It is cleaner, it gets you the badge artwork, and it opens retail channels that will not touch unlicensed product.

How Much Does a Licence Cost?

Between 4% and 12% of the model’s sales revenue, paid to the car maker.

That range comes from a listed company. Xinghui Model (Shenzhen 300043) told investors in July 2013 that it pays car makers a share of model car sales revenue. The filing puts the rate at “generally 4% to 12%”, settled quarterly, half-yearly or annually.

Two things push you to the top of that range.

Supercar and luxury brands charge more and often ask for an advance. Budget for the advance, not just the percentage.

Multi-party licences. A racing car carries the car maker, the team, the sponsor and sometimes the tyre brand. Each one can claim a fee. Racing replicas with several logos can stack well past the single-brand rate.

The licence also comes with work. Artwork approval, a sample sent to the licensor, and packaging that meets their brand rules. Build two to four weeks into the schedule for their review, and expect at least one round of comments.

If you skip the licence, price the risk properly. A detained shipment is not just the goods. It is the freight, the storage, the legal cost, and in some jurisdictions a penalty based on the goods value. Customs also reclassifies such shipments, which is why the duty code matters even when the tariff is zero.

What Does the Mould Really Cost?

Tooling is the line that decides whether an OEM diecast car project is viable. A new mould costs CNY 5,000 to 20,000 for a simple single-cavity tool, about USD 700 to 2,800. A complex multi-cavity tool with moving parts runs CNY 100,000 to 500,000, or USD 14,000 to 70,000.

The figure you see quoted everywhere — USD 300 to 1,000 — is not a mould. It is one of three other things:

A modification to an existing tool, such as a new logo pocket or a changed grille

A print plate charge for a new box design

A sample fee for a prototype

All three are legitimate costs. A factory that hesitates on that question is usually planning to reuse it. The factory vetting guide has the questions to ask before the quote.

Who Owns the Mould?

You do, if you paid for it and the contract says so. This is one more reason small first orders cost more per unit, as the MOQ breakdown shows on the volume curve.

For a first own-brand model at 1:64, 3,000 units is a realistic starting point. Budget USD 12,000 to 18,000 all in. That covers tooling, goods, packaging and testing. It does not cover freight or the licence.

How Do You Control Quality?

With a written standard and a sampling plan, agreed before the first shot.

Ask for AQL sampling to ANSI/ASQ Z1.4, level II, with critical at 0, major at 2.5 and minor at 4.0. Incomplete reference material. A supplier working from three photos will invent the rear end. Send orthographic views, wheel detail, interior shots and a colour reference. If you have no CAD, say so early — the factory can build it, but it adds two to three weeks.

3. Mould ownership left vague. Your model appears in another buyer’s catalogue a year later.

4. First sample approved too fast. A resin prototype looks close. The painted metal first shot is where colour drifts. Approve the decorated shot, not the resin.

5. Packaging decided last. Artwork, dieline and print add two to four weeks. Start it in parallel with tooling, not after it.

6. Licence review not in the plan. Two to four weeks, sometimes with a second round. If the licensor asks for a design change after the steel is cut, the mould change is real money.

7. No agreed AQL. “We check every piece” means nothing. If your channel cannot support that, the project does not work at any volume.

Tooling against expected sales. A USD 2,100 tool spread over 3,000 units adds USD 0.70 a unit. Spread over 20,000 it adds USD 0.11. If you expect to sell 3,000, the tool is a real cost. Plan a second model on the same body to spread it.

Time against your launch date. Five months for 1:64, nine for 1:18, plus freight. A launch set for a fixed date needs the brief to start five months earlier than most people plan.

Where OEM wins is control. Your body, your colour, your box, your brand, and nobody else selling it. Where it loses is flexibility. You cannot change the model next month, and you cannot test ten designs for the price of one.

If you want to test the market first, buy stock, relabel it and see what sells. Then build. That path costs more per unit and far less per mistake. The wholesale range is the place to start.

Perguntas frequentes

What is the minimum order for an OEM diecast car? 2,000 to 3,000 units for a new 1:64 body. That is where the tooling amortises to a workable share of the price. A modified existing tool can start at 240 to 500.

Can I make a model of my own car? Yes, and it is a common project. If it is a one-off personal vehicle, you still need the manufacturer’s permission if the badge and body shape are recognisable. Many owners start with a generic body and their own livery, which avoids the licence entirely.

How much does a custom diecast car cost? Tooling USD 700 to 2,800 for a simple 1:64 tool. Unit cost USD 1.50 to 3.50 at volume. A 3,000-unit first project lands near USD 12,000 to 18,000 before freight.

How long does a custom diecast car take? 145 to 150 days for 1:64 and 270 to 280 days for 1:18, measured to the point of shipment. Add sea freight on top. Anyone quoting 60 days for a new body is describing a stock model with a logo.

Do I own the mould? If you paid for it and the contract says so. Ask for ownership, marking, return and a no-third-party-use clause.

What if I do not have 3D files? The factory can build the model from reference material. It adds two to three weeks and a design fee. Send orthographic views and detail photos rather than a handful of press images.

Is a licence always required? For a recognisable production car, in practice yes. The legal position on the design is more forgiving than the customs position on import. Budget 4% to 12% of revenue and treat the advance as part of the cost.

Is OEM diecast car manufacturing possible at 500 units? Yes, at a unit price that carries most of the tooling. A 500-unit run of a new body often costs 2.5 to 3 times the volume price.
